REGISTRATION OF CHILD BIRTH

SITUATION 1 - APPLICATION FOR CITIZENSHIP UNDER ARTICLE 14 OF THE FEDERAL CONSTITUTION CONFIRMATION OF CITIZENSHIP (BORN OUTSIDE MALAYSIA)

1. Father and Mother is Malaysian citizen (baby is born after marriage)
2. Father is Malaysian citizen and Mother is Foreigner (baby is born after marriage)

A child born outside Malaysia can obtain a Malaysian nationality if his/her father is a citizen of Malaysia and Report of Birth to the Embassy of Malaysia within 1 year of birth (before the child becomes age 1).

Please bring your child with you when coming to the Embassy for birth registration. A registration form will be provided at the Embassy.

Required documents for Birth Registration as follows:

Child

1. Certificate of birth endorsed by the Ministry of Foreign Affairs at the country of origin (original and 2 photocopies)
2. Copy Residence Permit / Passport / other travel document.
3. 3 photographs (5 x 3.5 cm) (photos that the baby faces the front and its eyes open)
4. Registration fee (RM20 will be calculated based upon the current month’s exchange rate, to be paid in HUF or EUR)

Father

1. Malaysian passport (original to be presented and 2 photocopies to be submitted)
2. Birth certificate of Malaysia (original to be presented and 2 photocopies to be submitted)
3. Malaysian IC card (original to be presented and 2 photocopies to be submitted)
4. Certificate of marriage issued by the government of Malaysia (original to be presented and 2 photocopies to be submitted); or

Islamic Certificate of Marriage (issued by the Malaysian Islamic Authority) in case of Muslim (original to be presented and 2 photocopies to be submitted)

5. Residence Card in Hungary, Slovenia or North Macedonia (original and 2 photocopies) 

Mother

1. Passport (original to be presented and 2 photocopies to be submitted)
2. Birth certificate of Malaysia or from country of origin (original to be presented and 2 photocopies to be submitted)
3. Malaysian IC card (original to be presented and 2 photocopies to be submitted) (For Malaysian mother)
4. Residence permit (not required if the mother is Hungarian, Slovenian or North Macedonian)

Other sibling

1. Birth certificate of Malaysia or from country of origin (original to be presented and 2 photocopies to be submitted)
2. Malaysian IC card (original to be presented and 2 photocopies to be submitted) (if any)

SITUATION 2 - APPLICATION FOR CITIZENSHIP UNDER ARTICLE 15(2) OF THE FEDERAL CONSTITUTION CHILD UNDER THE AGE OF 21 WHOSE PARENT IS A CITIZEN

 
Mother is Malaysian and Father is Foreign Citizen (baby is born after marriage)

A child born outside Malaysia can apply for a Malaysian nationality if his/her mother is a citizen of Malaysia and Report of Birth to the Embassy of Malaysia within 1 year of birth (before the child becomes age 1). Above 1 year of age application should be made in Malaysia.

Please bring your child with you when coming to the Embassy for birth registration. A registration form will be provided at the Embassy.

Required documents for Birth Registration as follows:

Child

1. Certificate of birth endorsed by the Ministry of Foreign Affairs at the country of origin (original and 2 photocopies)
2. Residence Permit / Passport / other travel document (original and 2 photocopies)
3. 3 photographs (5 x 3.5 cm) (photos that the baby faces the front and its eyes open)
4. Registration fee (RM10 will be calculated based upon the current month’s exchange rate, to be paid in HUF or EUR)

Mother

1. Malaysian passport (original to be presented and 2 photocopies to be submitted)
2. Birth certificate of Malaysia (original to be presented and 2 photocopies to be submitted)
3. Malaysian IC card (original to be presented and 2 photocopies to be submitted)
4. Certificate of marriage issued by the government of Malaysia (original to be presented and 2 photocopies to be submitted)
5. or
6. Islamic Certificate of Marriage (issued by the Malaysian Islamic Authority) in case of Muslim (original to be presented and 2 photocopies to be submitted)
7. Residence Card in Hungary, Slovenia or North Macedonian (original and 2 photocopies) 

Father

1. Passport (original and 2 photocopies) 
2. Local Identity Card of Hungary, Slovenia or North Macedonia (original and 2 photocopies) 
3. Valid residence card/ work visa (if the father is non-Hungarian, Slovenian or North Macedonian national)
4. Birth certificate (must be translated from Hungarian, Slovenia or North Macedonian to English and endorsed by the Ministry of Foreign Affairs of Hungary, Slovenia or North Macedonia. For non-citizens of Hungary, Slovenia or North Macedonia, please bring the original document translated in English for legalization / attestation at the respective Embassy in Hungary, Slovenia or North Macedonia, where the original document was issued)

Other sibling

1. Birth certificate of Malaysia or from country of origin (original to be presented and 2 photocopies to be submitted)
2. Malaysian IC card (original to be presented and 2 photocopies to be submitted) (if any)
3. Residence Permit / Passport / other travel document (original and 2 photocopies)

MARRIAGE REGISTRATION

I. NON-MUSLIM MARRIAGE

A non-Muslim Malaysian citizen who has contracted a marriage in Hungary, Slovenia or North Macedonia MUST register the marriage with the Embassy of Malaysia in Budapest, Hungary within 6 months from the date of marriage. This is a legal requirement under the Law Reform (Marriage and Divorce) Act 1976 of Malaysia and it is an offence if you fail to do so within the prescribed time.

The procedure requires both husband and wife to appear personally at the Embassy and produce the following documents:

a. Registration form (to be obtained at the Embassy);

b. Malaysian IC card for Malaysians (husband/wife, original and 2 photocopies);

c. Local identity card of non-Malaysian spouse (husband/wife, original and 2 photocopies);

c. Passport (details page) for both husband and wife (original and 2 photocopies);

d. Residence card in Hungary, Slovenia or North Macedonia (for Malaysian applicant and non-Malaysian spouse who is nor Hungarian, Slovenia or North Macedonian);

e. 2 recent passport size photographs of both husband and wife;

f. Original Birth Certificate of non-Malaysian spouse (must be translated into English and endorsed by the Ministry of Foreign Affairs of Hungary, Slovenia or North Macedonia. For non-citizens of Hungary, Slovenia or North Macedonia, please bring the original document translated in English for legalization / attestation at the respective Embassy in Hungary, Slovenia or North Macedonia, where the original document was issued);

g. Original Marriage Certificate (must be translated into English and endorsed by the Ministry of Foreign Affairs of Hungary, Slovenia or North Macedonia);

h. Registration fee (RM20 will be calculated based upon the current month’s exchange rate, to be paid in HUF or EUR)

II. MUSLIM MARRIAGES

Muslim marriages can only be registered at the specific Jabatan Agama Islam in the state where you are registered in Malaysia. The Muslim Marriage Certificate issued by Imam or Mufti in Hungary, Slovenia or North Macedonia has to be translated to English, endorsed by the Ministry of Foreign Affairs of Hungary, Slovenia or North Macedonia and attested by the Embassy of Malaysia in Budapest, Hungary for it to be valid.

Muslim marriages can only be registered at the Jabatan Agama Islam in the state where you are registered in Malaysia, however, prior to that the Embassy of Malaysia in Budapest, Hungary will have to issue an endorsement letter for you to be able to do so.

The procedure requires both husband and wife to appear personally at the Embassy and produce the following documents:

1. Islamic marriage certificate (translated into English and in Hungary first needs to be endorsed by Mr. Tibor Hornisch Church Coordination and Liaison Department, postal address: 1357 Budapest, Pf. 6. It will take approx. 1 working day to verify the marriage certificate and mail it back to the sender. Please do not forget to write the name and address on the envelope for easy return of the document.)
2. After this, further endorsement is required by the MFAT in Hungary.
3. Original MyKad for Malaysian applicant (husband/wife 2 photocopies);
4. Original passport (details page) for both husband and wife (2 photocopies);
5. Residence card in Hungary (for Malaysian applicant and non-citizens of Hungary, Slovenia or North Macedonia spouse);
6. Original Surat Kebenaran Berkahwin obtained from Pejabat Agama Islam Negeri in Malaysia (2 photocopies);
7. Original conversion letter (2 photocopies, applicable to spouse who was a non-Muslim before the Muslim marriage took place)
8. Original and copy of birth certificate (must be in English or translated to English and endorsed by the Ministry of Foreign Affairs of Hungary, Slovenia or North Macedonia. Non-citizens of Hungary, Slovenia or North Macedonia, please bring the original document with translation in English for attestation / legalisation at the respective Embassy in Hungary where the original document was issued).
9. Fee of RM20 for endorsement of marriage certificates (will be calculated based upon the current month’s exchange rate, to be paid in HUF or EUR)

*The Embassy will issue a letter (surat iringan) to the specific Pejabat Agama Negeri where he/she obtains her Surat Kebenaran Berkahwin. The Muslim couples have to bring the original letter back to Malaysia to file for marriage registration in person at the specific Pejabat Agama Negeri.

Please note that all of the above-mentioned fee has to be bank transferred before coming in to the Embassy.
