HIGH COMMISSION OF MALAYSIA

APPLICATION FOR BIRTH REGISTRATION

A child born in the Republic of South Africa / Mozambique/Botswana/Lesotho/Madagascar/Eswatini on or after Malaysia Day (16 September 1963) whose father is at the time of the birth is a citizen of Malaysia and whose birth is registered at the High Commission of Malaysia within one (1) year from the date of birth is a citizen of Malaysia by operation of law under Article 14 of the Federal Constitution of Malaysia.   

Conditions

1. Child born in Republic of South Africa on or after Malaysia Day.

2. Father of the child is a Malaysian citizen when the child was born.

3. Child’s birth must be registered at the High Commission of Malaysia within one (1) year from the child’s date of birth.

Procedures

1. Father/Mother and the child to be registered shall appear before the Consular Officer at the High Commission of Malaysia when submitting the application in accordance with Rule 28 of the Citizenship Rules 1964 (Amendment 1996).

2. Application hours: 9:30 a.m. – 12:00 p.m. on any weekday, except for public holidays.

3. Appointment is required.

4. Applications are to be made using Form D (available only at the High Commission) and submitted along with the original and two (2) photocopies of each of the required documents.

Required documents

1. For the child:

1. Three (3) coloured passport-sized photograph (in the size of 3.5 cm x 5 cm with plain blue or white background); and

2. Child’s local birth certificate;

2. For the father:

1. Passport;(at the time of the child’s birth)

2. Malaysian identity card (MyKad) front and back on A4 paper

3. Birth certificate; and

4. Valid Permit/Residence/TRV/Visa in Republic of South Africa.

3. For the mother:

1. Passport;

2. Malaysian identity card (not applicable if mother is not a Malaysian citizen);

3. Birth certificate (not applicable if mother is not a Malaysia citizen); and

4. Valid Permit/Residence/TRV/Visa in Republic of South Africa (not applicable if mother is a Republic of South African national).

4. Parents’ evidence of marriage:

1. Parents’ Malaysian marriage certificate.

Fees

1. Application fee = RM20.00.

2. Form H fee = RM10.00.

3. Fees are fixed in Ringgit Malaysia but payable in equivalent Republic of South African Rand based on the exchange rate of the Accountant General of Malaysia at the time of application.

APPLICATION TO REGISTER A MARRIAGE CONTRACTED UNDER THE LAW OF SOUTH AFRICA

Any non-Muslim Malaysian citizen who contracted a marriage under the law of South Africa or in any accredited countries ( Mozambique/Botswana/Madagascar/Eswatini/Lesotho)   must register the marriage at the Embassy of Malaysia in Pretoria within six (6) months after the date of the marriage.

If the said Malaysian citizen returns to Malaysia (with or without his/her spouse) within six (6) months after the date of such marriage without registering the marriage at the Embassy of Malaysia in Pretoria, he/she is required to register the marriage at any office of the National Registration Department of Malaysia (JPN) within six (6) months from the date of his/her arrival in Malaysia.

Please be reminded that Section 35 of the Law Reform (Marriage and Divorce) Act, 1976 of Malaysia states “Any person who, being required by section 31 to appear before a Registrar, omits to do so within the prescribed time shall, on conviction, be liable to imprisonment for a term not exceeding one year or to a fine not exceeding one thousand ringgit or to both.”

Conditions

1. One of the parties to the marriage is a non-Muslim citizen of Malaysia.

2. The marriage is legally contracted under the law of South Africa or accredited countries.

3. Registration is done within 6 months after the date of marriage.

4. Late registrations shall be subjected to a penalty.

ProcedureS

1. Applications must be made at the High Commission in person.

2. Application hours: 9:30 a.m. – 12:00 p.m. on any weekday, except for public holidays.

3. Appointment is required. 

4. Applications are to be made using Form JPN.KC06 and submitted along with the original and two (2) photocopies of each of the required documents.

5. Required documents which are not in Bahasa Malaysia or English must be accompanied by a Bahasa Malaysia or an English translation translated by a licensed translator.

Required documents

1. Malaysian citizen(s):

1. One (1) recent coloured passport-sized photograph (in the size of 3.5 cm x 5 cm with plain blue or white background);

2. Valid Passport;

3. Malaysian identity card; and

4. Visa/ Permit (TRV) in South Africa or accredited countries

2. For the other party to the marriage if he/she is a foreign national:

1. Two (2) recent coloured passport-sized photograph (in the size of 3.5 cm x 5 cm with plain blue or white background);

2. Valid Passport and/or Identity Card

3. Local residence permit (TRV) in South Africa (not applicable if he/she is a South African or accredited countries citizen).

3. Evidence of Marriage:

1. Marriage Certificate issued by Department of Home Affairs of South Africa or any equivalent competent authority in the country of residence/accredited countries

FeeS / PENALTY

1. Marriage Register fee = RM20.00.

2. Late penalty:

RM50.00 for the first year; and

RM100 for each subsequent year or part thereof.

3. Fee penalty are fixed in Ringgit Malaysia but payable in equivalent/nearest South African Rand based on the exchange rate of the Accountant General of Malaysia at the time of application.
