Birth/Marriage Certificate

REGISTRATION OF CHILD BIRTH

 

A child born in United Arab Emirates (UAE) on or after Malaysia Day (16 September 1963) whose father is at the time of the birth is a citizen of Malaysia and whose birth is registered at the Embassy of Malaysia within one year from the date of birth is a citizen of Malaysia by operation of law under Article 14 of the Federal Constitution of Malaysia.

 

Application Requirements:

 

  1. The applicant and the person to be registered shall appear before the Registrar of Citizenship/Consular Officer when submitting the application in accordance with Rule 28 of the Citizenship Rules 1964 (Amendment 1996).

 

  1. The applicant shall be the parent or guardian or next of kin.

 

  1. Form D (JPN.WN02) must be completed and submitted together with copies of the necessary documents.

 

Required Documents: -

     

  1. Form D JPN.WN02 (can be obtained at the Embassy);
  2. Original and two (2) copies of child’s birth certificate issued by the competent authority of UAE duly legalised by the Consular Department, Ministry of Foreign Affairs and International Cooperation UAE;
  3. Original and two (2) copies of parent’s birth certificate;
  4. Original and two (2) copies of parent’s identity card (back & front);
  5. Original and two (2) copies parent’s citizenship certificate (if applicable);
  6. Original and two (2) copies of parent’s passport & visa page;
  7. Original and two (2) copies of parent’s Emirates ID card (EID);
  8. Original and two (2) copies of parent’s marriage certificate; and
  9. Three (3) recent passport size photographs of the child.

 

Fees: 

Application and Birth Registration (Form H) fees= AED30.00 

Attestation fee: AED 25.00

 

Mode of payment: Cash only.

 

Processing Time: Three (3) working days

 

Note:

  1. All foreign documents issued outside of UAE must be certified and attested by a government representative of the country in UAE (eg. Embassy/Consulate). If these documents are not in English, they must be translated and attested by the government representative.

 

  1. Kindly bring along all the original documents and to provide two (2) photocopies of each document in A4 size.

REGISTRATION OF MARRIAGE

 

Any non-Muslim Malaysian citizen who contracted a marriage under the law of United Arab Emirates (UAE) must register the marriage at the Embassy within six (6) months after the date of the marriage.

 

If the said Malaysian citizen returns to Malaysia (with or without his/her spouse) within six (6) months after the date of such marriage without registering the marriage at the Embassy, he/she is required to register the marriage at any office of the National Registration Department of Malaysia within six (6) months from the date of his/her arrival in Malaysia.

 

Please be reminded that Section 35 of the Law Reform (Marriage and Divorce) Act, 1976 of Malaysia states “Any person who, being required by section 31 to appear before a Registrar, omits to do so within the prescribed time shall, on conviction, be liable to imprisonment for a term not exceeding one year or to a fine not exceeding one thousand ringgit or to both.”

 

Application Requirements:

 

  1. The couple are required to be present at the Embassy for the application and registration of marriage.
  2. One of the parties to the marriage is a non-Muslim citizen of Malaysia.
  3. The marriage is legally contracted under the law of UAE.
  4. Registration is done within 6 months after the date of marriage.
  5. Late registrations shall be subject to a penalty.

 

Required Documents:

 

  1. Form JPN.KC 06 - two copies (can be obtained at the Embassy);
  2. Original and two (2) copies of Foreign Marriage certificate (original document should be attested by Consular Department, Ministry of Foreign Affairs and International Cooperation UAE);
  3. Original and two (2) copies of spouse’s birth certificate (for non-citizen);
  4. Original and two (2) copies of couple’s identity card;
  5. Original and two (2) copies of couple’s passport (Pages containing personal details and Visa page);
  6. Original and two (2) copies of couple’s Emirates ID card (EID);
  7. Original and two (2) copies of Decree nisi absolute (divorce certificate), if applicable;
  8. Original and two (2) copies of Death certificate of previous spouse, if applicable; and
  9. Two (2) recent passport-size photographs of each person.

 

Fees:    

A. Marriage Registration:

  1. JPNKC 07       AED35.00

 

B. Marriage at Embassy:

  1. JPNKC 03       AED15.00
  2. JPNKC 05       AED35.00

                      

C. Penalty for Late Registration:

  1. AED 100.00 for the first year.
  2. AED 50.00 for each subsequent year or part thereof.

APPLICATION FOR A CERTIFICATE OF NO IMPEDIMENT TO THE MARRIAGE

 

This certificate is issued to facilitate applications to contract a marriage in United Arab Emirates (UAE) among Malaysian citizens as required by the UAE authorities. It confirms the marital status of its bearer and contains a statement whether or not the Embassy has any objection for the bearer to contract a marriage in UAE.

 

Application Requirements:

 

  1. Application must be done in person at the Embassy.

 

Required Documents for Non-Muslim Applicants:

 

  1. For Malaysian citizen(s):
  1. Original and two (2) copies of Passport;
  2. Original and two (2) copies of Malaysian identity card;
  3. Original and two (2) copies of Emirates ID card (EID); and
  4. Original and two (2) copies of Letter from the National Registration Department of Malaysia confirming the applicant’s marital status duly legalised by the Consular Officer of the Ministry of Foreign Affairs, Malaysia;

 

  1. For the other party to the proposed marriage if he/she is a foreign national:
  1. Original and two (2) copies of Passport (for a UAE national, identity card is also acceptable if he/she does not have a passport); and
  2. Original and two (2) copies of Emirates ID card (EID card), (not applicable if he/she is a UAE citizen).

 

Required Documents for Muslim Applicants:

 

  1. Malaysian citizen(s):

 

  1. Original and two (2) copies of Authorisation letter to contract an Islamic marriage overseas from the Islamic Religious Affairs Department of the State where the applicant resides in Malaysia duly legalised by the Consular Officer of the Ministry of Foreign Affairs, Malaysia;
  2. Original and two (2) copies of Passport;
  3. Original and two (2) copies of Malaysian identity card; and
  4. Original and two (2) copies of Emirates ID card (EID card) in UAE.

 

  1. For the other party to the proposed marriage if he/she is a foreign national:
  1. Original and two (2) copies of Passport (for a UAE national, identity card is also acceptable if he/she does not have a passport); and
  2. Original and two (2) copies of Emirates ID card (EID), (not applicable if he/she is a UAE citizen); and
  3. Original and two (2) copies of Certificate of conversion to Islam (if applicable).

 

Fee:

Certificate fee = AED 20.00 (cash only)

 

Processing Time: Three (3) working days

NOTICE OF MARRIAGE AND WRITTEN DECLARATION

 

Non-Muslim Malaysian citizens in United Arab Emirates (UAE) may also elect to be married at the Embassy of Malaysia in Abu Dhabi or Consulate General Malaysia in Dubai in accordance with Section 14, 16 and 26 of the Law Reform (Marriage and Divorce) Act 1976 of Malaysia.

 

Conditions:

 

  1. One of the parties to the marriage is a Malaysian citizen.
  2. Both parties to the marriage have the capacity to marry according to the Law Reform (Marriage and Divorce) Act 1976 of Malaysia.
  3. Both parties to the marriage must reside at least seven (7) days in UAE prior to submitting their applications for marriage using a prescribed Form JPN.KC02 to the at the any of the missions.
  4. Form JPN.KC02 shall be displayed for a minimum period of 21 days at the any of the missions and also at the office of the National Registration Department of Malaysia, nearest to applicant’s or applicants’ address in Malaysia.
  5. A certificate (permission) for marriage shall be issued only if the Form JPN.KC02 of the parties to the marriage received no caveat from any member of public during the 21 days public viewing at the any of the missions and at the office of the National Registration Department of Malaysia in Malaysia.
  6. Marriage registration and solemnisation must take place at the Embassy of Malaysia in at the any of the missions within six (6) months from the date of application, failing which the application and all proceedings consequent thereon shall be void and a fresh application will have to be given before the applicants can lawfully marry.
  7. Applicants shall bring two (2) witnesses of at least 21 years of age to witness the marriage solemnisation/registration and applicants will receive their Marriage Registers after the marriage solemnisation/registration.

 

Application Requirements:

 

  1. Applications must be made at the Embassy in person.
  2. Applications are to be made using Form JPN.KC02 in triplicate and submitted along with the original and three (3) photocopies of each of the required documents.
  3. Required documents which are not in Bahasa Malaysia or English must be accompanied by a Bahasa Malaysia or an English translation translated by a qualified/licensed translator.

 

Required Documents:

 

  1. Malaysian citizen(s):
  1. Three (3) recent identical coloured passport-sized photographs (in the size of 3.5 cm x 5 cm with plain blue or white background);
  2. Original and three (3) copies of Passport;
  3. Original and three (3) copies of Malaysian identity card;
  4. Original and three (3) copies of Emirates ID card (EID); and
  5. Original and three (3) copies of Letter from the National Registration Department of Malaysia confirming the applicant’s marital status duly legalised by the Consular Officer of the Ministry of Foreign Affairs, Malaysia.

 

  1. For the other party to the proposed marriage, he/she is a foreign national:
  1. Three (3) recent identical coloured passport-sized photographs (in the size of 3.5 cm x 5 cm with plain blue or white background).
  2. Original and three (3) copies of Passport (for a UAE national, identity card is also acceptable if he/she does not have a passport)
  3. Original and three (3) opies of Birth certificate/Family Register;
  4. Original and three (3) copies of Emirates ID card (EID), (not applicable to UAE national); and
  5. Proof of single status e.g., a family register issued by the competent authority of UAE duly legalised by the Consular Department, Ministry of Foreign Affairs and International Cooperation UAE or a letter/certificate of single status (if single), a divorce certificate/decree absolute (if a divorcee), a death certificate of late spouse (if a widow) issued by the competent authority of applicant’s country duly legalised by the Consular Officer of the Diplomatic Mission of the applicant’s country in UAE.

 

Fees:

  1. Certificate (permission) for marriage fee = AED 10.00.
  2. Marriage Register fee = AED 20.00.

 

Processing Time: Six (6) months.
