Birth/Marriage Registration

Application for citizenship under Article 14 of the Federal Constitution confirmation of citizenship (born outside Malaysia)

 

Reason for Application

This is an application to confirm the status of a person born outside Malaysia on or after Malaysia Day (16 September 1963) based on the status of the father.

 

 

Application Condition

1.   The applicant and the person to be registered shall appear before the Registrar of Citizenship/consular officer when submitting the application in accordance with Rule 28 of the Citizenship Rules 1964 (Amendment 1996).

 

2.   The applicant shall be the:

  • parent;
  • guardian or next of kin

 

3.   Form D must be completed and submitted together with copies of the necessary documents. The original form could be obtain at the High Commission of Malaysia.

 

 

Application Procedure

The applicant and the person to be registered are required to go to the counter at the Citizenship Division of the Putrajaya National Registration Department (NRD) headquarter/state NRD headquarters or the High Commission of Malaysia in Port Moresby, Papua New Guinea. Applicants are required to bring along the originals and copies of the following documents:

 

 

Required Documents

 

1.   REGISTRANT’S DOCUMENTS (ORIGINALS AND COPIES)

  • Birth Certificate or latest extract of Birth Certificate (translated into Malay or English by the court/consular office/public translator);
  • Entry permit or passport or other travel document; and
  • Three (3) recent passport-sized photographs with a white background.

 

2.   PARENTS’ DOCUMENTS (ORIGINALS AND COPIES)

  • Birth Certificate or latest extract of Birth Certificate;
  • Identity card (if any);
  • Passport or other travel document;
  • Citizenship Certificate; and
  • Marriage document.

 

Note: All copies of supporting documents should be made on A4 paper

 

 

Payment

  • RM20.00 for application fee;
  • RM10.00 for issue of the certificate by the consulate (if approved); and
  • RM30.00 for issue of the certificate by the Registrar-General of Citizenship with the approval of the Minister of Home Affairs, Malaysia.

 

Notice

1.   All applications for citizenship matters require the use of original forms which may be obtained from the Putrajaya NRD headquarters or state NRD headquarters/branches. Application forms for registration of birth in a foreign country and renunciation of citizenship may be obtained from the High Commission of Malaysia.

 

2.   Where a child is born before the parents’ marriage is registered, the child’s status follows that of the mother as stated in Section 17, Part III of the Second Schedule of the Federal Constitution.

REGISTRATION OF MARRIAGE FOR MALAYSIAN NON-MUSLIM

 

General Information

1.   Registration of marriage is COMPULSORY for a non-Muslim Malaysian.

 

2.   Non-Muslim foreigner living in Malaysia may apply to register their marriage under this act.

 

3.   Place for solemization and marriage registration:

  • Malaysian

i.   National Registration Department, Malaysia

ii.  High Commission of Malaysia in Port Moresby, Papua New Guinea

iii. Church / Temple / Association by Assistant Registrar of Marriages in Malaysia

 

  • MyPR Holders/MyKAS Holders with Malaysian/non-Malaysian

i.   National Registration Department Offices, Malaysia

 

  • Malaysian with non-Malaysian

          i.  National Registration Department Offices in Malaysia

          ii. High Commission of Malaysia in Port Moresby, Papua New Guinea

 

  • Non-Malaysian

         i.  National Registration Department, Malaysia

 

 

Application Requirements

1.   Applicants are required to submit the application in person to the National Registration Department, Malaysia (NRD) counter or the High Commission of Malaysia in Port Moresby, Papua New Guinea.

 

2.   The place of application is based on the address stated in the MyKad (for Malaysian) or the residential address in Malaysia (for non-Malaysian). This requirement does not apply for solemnization and registration of marriages in churches, temples and associations in Malaysia.

 

3.   The applicant must reside in the district where the marriage is to take place for at least 7 days +1 day prior to submitting the application for registration of marriage in the relevant NRD office. This condition requirement does not apply for solemnization and registration of marriages in churches, temples and associations in Malaysia.

 

4.   Registration of marriage shall take place after 21 days + 1 day and not later than 6 months from the date of application. For marriage application submitted to the High Commission of Malaysia in Port Moresby, Papua New Guinea, the application will be sent to the NRD office based on the address in the MyKad to be displayed for at least 21 days + 1 day.

 

5.   Non-Malaysian must produce a letter from his/her government to confirm his/her marital status (Affidavit/Notary Certificates/ Apostille/ Statutory Declaration are not accepted). A letter issued by the Papua New Guinea government must be re-certified by the High Commission of Malaysia in Port Moresby, Papua New Guinea.

 

6.   A verification letter from the respective government that the applicant is not a Muslim (i.e. Iran, Iraq, Egypt, Algeria, Pakistan, Bangladesh or other Muslim countries or from any other countries, if required).

 

7.   During the registration of marriage, it is the responsibility of the applicant to engage with an interpreter in the event of he/she does not understand Malay or English. Any document containing foreign language submitted to NRD shall be accompany by a full Malay or English language translation.

 

Required Documents

1.   2 X JPN. KC06 form.

2.   2 X photocopies of PNG Civil Registrar Marriage Certificate

3.   2 X photocopies of couple’s passport (biodata page, visa and work permit copy)

4.   2 X current passport-size photographs of each person (clear white background)

5.   2 X photocopies of couple’s nationality birth certificate

6.   2 X photocopies of couple’s nationality identity card

7.   A cover letter stating the purpose of application.

8.   ORIGINAL letter verifying marital status of a non-Malaysian applicant which had been certified by the High Commission of Malaysia in Port Moresby, Papua New Guinea. Note: Validity of the letter – 6 month from the date of issue if no validity date stated (Affidavit/Notary Certificate/ Apostille/Statutory Declaration are not accepted).

9.   A verification letter from the respective government that the applicant is not a Muslim (i.e. Iran, Iraq, Egypt, Algeria, Pakistan, Bangladesh or other Muslim countries or from any other country, if required).

10.   Decree absolute (divorce certificate), if applicable.

11.   Death certificate of previous spouse, if applicable.

 

Note:  All the above documents must be translated into Malay or English by a qualified translator. The translation must include name, signature, position, contact details of translator and date of translation.

 

 

Payment

1.   RM10.00 for certificate for marriage; and

2.   RM20.00 for Marriage Certificate

 

 

Reminder on Day of Solemnisation of Marriage

The couple, together with 2 witnesses aged 21 and above, MUST:

1.   Bring along their ORIGINAL MyKad (Malaysian)/passports (non-Malaysian);

2.   Be decently and neatly dressed (T-shirt/jeans/flip-flops/shorts are NOT ALLOWED)
