ON AGENDA ITEM 87:
STRENGTHENING AND PROMOTING THE INTERNATIONAL TREATY FRAMEWORK

Mr. Chair,
1. Malaysia welcomes the Secretary-General’s report on the role of technology in shaping treaty-making practice and acknowledges its relevance in modernizing international legal processes. As a committed member of the international community, Malaysia supports the integration of technology while upholding the integrity of legal procedures and constitutional mandates.
2. Malaysia affirms its strong support for the use of secure and transparent digital platforms in treaty negotiations, recognizing their value in enhancing inclusivity, efficiency, and real-time collaboration across borders. The shift towards virtual diplomacy has enabled broader participation and strengthened regional and international engagement, particularly in multilateral settings such as ASEAN and the United Nations. Malaysia remains committed to embracing digital innovation in diplomacy, confident that it will continue to foster meaningful cooperation and resilient partnerships in an increasingly interconnected world.
3. Further, Malaysia aligns with the view of the Secretary-General that while electronic submission of instruments through email generally be accepted, the subsequent transmission of the original hardcopy remains essential.
4. Malaysia strongly supports the integration of technology in capacity-building initiatives related to international law and treaty practice, recognizing its role in enhancing the expertise of legal personnel and strengthening institutional competence. Through the dissemination of online resources and training, Malaysia is committed to equip its legal personnel with the necessary tools to navigate complex treaty frameworks to ensure

Nevertheless, Malaysia reiterates its view to support the approach that the registration of treaties or international agreements to the depositary pursuant to Article 1 paragraph 3 of the Regulations to Give Effect to Article 102 of the Charter of the United Nations should be encouraged and not be made obligatory, as this would be in accordance with Article 77 of Vienna Convention on the Law of Treaties.
