AGENDA ITEM 86: PROTECTION OF PERSONS IN THE EVENT OF DISASTERS

 

WORKING GROUP DISCUSSION ON CLUSTER V:

FACILITATION OF EXTERNAL ASSISTANCE (DRAFT ARTICLES 15, 16 AND 17)

Mr. Chair,

 

1.         Malaysia recognizes the importance of facilitating the entry and protection of relief personnel, equipment, and goods in reference to Cluster IV. However, my delegation emphasizes that such facilitation must be conducted in accordance with the Affected State’s domestic legislation, established national procedures, and relevant security considerations. Furthermore, Malaysia believes that the principle of facilitation should be implemented in a way that fully respects the affected state's domestic legal and institutional frameworks while promoting effective international cooperation.

 

2.         In light of these views, Malaysia proposes amendments to Articles 15 and 16. We suggest adding the phrases “within its national law” and “policy” to these articles to further underscore the importance of implementing facilitation and assistance in a manner that fully respects the Affected State’s domestic legal and institutional frameworks, including its policies. This proposal is meant to honor domestic legislation, national procedures, and security considerations.

 

3.         Malaysia reserves the right to provide additional, detailed feedback on the draft articles as discussions continue, including during subsequent clusters and phases of the process. This concludes our comments on Cluster V.
